Heidelberg Engineering GmbH, Max-Jarecki-Str. 8, 69115 Heidelberg (hereinafter referred to as "Heidelberg Engineering") provides a distributor portal for business partners at the web address he-information-portal.com (hereinafter referred to as the "Portal"), through which visitors can purchase equipment, spare parts and software, download files and access other available content. Welcome to our distributor portal (“portal”). We maintain this portal as a service to our customers. By using the protal, you are agreeing to comply with and be bound by the following Terms of Use. Use of this portal constitutes your acceptance of all the following Terms of Use, in their current form or as modified.

  1. Subject to your compliance with all of the provisions of these Terms of Use, Heidelberg Engineering hereby grants you a single, terminable, non-transferrable, non-exclusive license to access and use the portal solely as provided herein and not the right to download (other than page caching and other than the product brochures, tutorials, quick guides and training videos that you are permitted to download through links on the portal) or modify the portal or any information or data therein. You may use the portal to browse Heidelberg Engineerings’s product information, to request technical support and to communicate with us. Notwithstanding anything to the contrary herein, all rights not specifically granted in the license set forth above shall be reserved and remain always with Heidelberg Engineering.
    A claim to the use of the services or content available on the portal exists only within the scope of the technical and operational possibilities of the service provider. The service provider endeavors to ensure that the usability of its services is as uninterrupted as possible. However, temporary restrictions or interruptions may occur due to technical malfunctions (such as interruption of the power supply, hardware and software errors, technical problems in the data lines).

The provision of this portal and the content therein shall not be construed by implication or otherwise as granting to the user rights to any copyright, trademark, patent or other protective rights or intellectual property right (in the portal or the content therein) of Heidelberg Engineering or any third party.

  3. You will use the portal in accordance with all applicable laws. Heidelberg Engineering may, without notice, terminate your access to the portal or take other actions as are reasonably necessary to comply with legal requirements and as necessary to protect the security and integrity of the portal, especially in the case of violation of these Terms of Use or misuse of the portal.

  4. You are solely responsible for any and all acts and omissions that occur under your login to the Site. You also shall not engage in unacceptable use of the Site, in particular to:

The content, in particular all product brochures, tutorials, quick guides and training videos, contained within or linked into the Site as well as organization, graphics, design, compilation, and other matters related to the Site are protected under applicable European and international copyright, trademark, protective and other rights (in particular, intellectual property). The logos, registered trademarks, word and image marks and names used as trademarks are the property of Heidelberg Engineering GmbH and/or its subsidiaries. The posting of information or materials on the Site by Heidelberg Engineering does not constitute a waiver of any rights in such information and materials. Heidelberg Engineering and/or our subsidiary Heidelberg Engineering Inc. exclusively owns all worldwide right, titles and interests in and to all documentation, software, contents, graphics, designs, data, computer codes, ideas, know-how, layout, compilations, magnetically stored translations, digital conversions and other materials included on the Site or available via the Site, and all modifications and derivative works thereof, and all intellectual property rights related thereto. You shall not challenge, contest or otherwise call into question Heidelberg Engineering’s or Heidelberg Engineering GmbH’s rights in the Site and the content therein and/or the validity Heidelberg Engineering GmbH’s intellectual property rights in the Site and the content therein. We reserve the right at our sole discretion to edit or delete any documents, information or other content appearing on the Site at any time without notice. Product, terms and other information provided on this Site are subject to change without notice.

  6. Any and all data that we obtain from you personally or from transactions processed through our Site, including names, addresses, telephone numbers, e-mail addresses and any other information concerning use, transactions, and traffic through the Site may be collected and used by us as provided by the relevant data protection provisions in our Privacy Policy.

    7.1 Otherwise, the following applies to Heidelberg Engineering GmbH’s liability:

    7.1.1 Heidelberg Engineering shall be liable for damage that is caused willfully or by negligence by Heidelberg Engineering or its legal representatives or vicarious agents, to an unlimited amount.

    7.1.2 In the case of damage resulting from the loss of life, bodily injury or damage to health, the liability of Heidelberg Engineering shall be unlimited, even in the case of slightly negligent violation of duty on its own part or on the part of its legal representatives or vicarious agents.

    7.1.3 In the case of slightly negligent violation of duty, Heidelberg Engineering shall be liable for damage from the violation of essential contractual duties, without which the achievement of the purpose of the contract is not possible and the compliance of which you rely on regularly, limited to the foreseeable damage typical of the contract. This applies accordingly for the negligent violation of essential contractual duties of Heidelberg Engineering’s legal representatives, organs or vicarious agents.

    7.1.4 Except in the case of intent or gross negligence, Heidelberg Engineering shall not be liable for indirect damage, such as additional expenses, lost profit or missed savings.

  8. If any provision of these Terms of Use is or becomes invalid or unenforceable, the remaining provisions of the Terms of Use remain unaffected thereby and retain their full validity.

  9. The Terms of Use are governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
